1? Orang kafir tak dapat masuk Mekah sebab adalah perintah Allah sebagaimana firman-Nya berkut ini:
يَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْمُشْرِكُونَ نَجَسٌ فَلَا يَقْرَبُوا الْمَسْجِدَ الْحَرَامَ بَعْدَ عَامِهِمْ هَٰذَا
“H4i orang-0rang yang berim4n, Sesungguhny4 orang-or4ng yang musyr1k itu naj1s, mak4 janganl4h merek4 mendekat1 Masjidil har4m setel4h t4hun in1 (y4itu t4hun penakluk4n k0ta Mekk4h)” (At-Taub4h :28)
Maksudnya masjid haram di sini adalah masjid haram serta
juga tanah haram. Terkait faktor ini Imam at-Thabari mengatakan:
فلا تدعوهم أ يقربوا المسجد' الحرابدخولهم الحرم . وإنما عنى بذلك منم من دخول الحرم ، لأنهم إ دخلو' الحرم فقد قربوا المس الحرا
“Janganl4h and4 biark4n merek4 (or4ng k4fir) mendek4ti masjid1l har4m deng4n m4suk ke k0ta Mekk4h. Maka perhatikanlah larangan terhadap mereka memasuki kota Mekkah sebab apabila mereka masuk, mereka bakal mendekati Masjidil Haram.” (Tafsir At-Thabari)
2? Pendapat lainnya. Dalam tafsir Fathul Qadir karya Imam Syaukani dikatakan:
والمراد بالمسجد الحرام جميع الحرم
Yang dimaksudkan dengan masjid haram adalah semua tanah haram.
Dalam tafsir tersebut juga dikatakan:
ذهب غيره من أهل العلم إلى أن المراد المسجد الحرام نفسه فلا يمنع المشرك من دخول سائر الحرم .
Ada juga yang menganggap bahwa yang dimaksudkan dengan masjid haram adalah masjid haramnya itu sendiri. Sehingga orang musyrik boleh masuk ke tanah haram lainnya (Selain masjid)
? Walau demikian, tak sedikit para ulama serta juga Penguasa Arab Saudi yang memilih pendapat pertama, yaitu bahwa yang dimaksudkan dengan masjid haram adalah tanah Haram.
Untuk menerapkan pemahaman atas pendapat di atas, pemerintah Arab Saudi sangat ketat menjaga tanah haram agar tak dimasuki orang kafir dengan tutorial meperbuat beberapa pemeriksaan serta sweeping untuk setiap orang yang bakal memasuki dua tanah haram. Setiap bakal masuk jalan meuju Mekkah bakal diperiksa bukti diri masing-masing.
