Para ulama membagi hewan menjadi 3:
[1] Hewan yang diperintahkan syariat untuk dibunuh
Seperti kalajengking, ular, tikus, anjing hitam, dst. Disamping binatang ini berbahaya, mereka juga mengganggu.
Rasulullah shallallahu’alaihi wa sallam bersabda,
خَمْسٌ مِنَ الدَّوَاب كُلُّهَا فَوَاسِقُ تُقْتَلُ فِى الْحَرَمِ الْغُرَابُ وَالْحِدَأَةُ وَالْكَلْبُ الْعَقُورُ وَالْعَقْرَبُ وَالْفَارَةُ
“Lima hewan yang semuanya jahat (mengganggu), boleh dibunuh walau di tanah suci; burung gagak, burung hering, anjing yang suka melukai, kalajengking dan tikus.” (HR. Muslim 2924).
[2] Hewan yang mengganggu
Hewan pengganggu, boleh dibunuh, sekalipun tidak ada perintah dari syariat untuk membunuhnya.
Seperti binatang buas yang membahayakan, nyamuk, semut yang mengganggu, kecoa yang mengganggu, tawon yang ganggu atau lalat.
[3] Hewan yang tidak mengganggu
Hewan yang tidak mengganggu, tidak boleh dibunuh. Nabi shallallahu ‘alaihi wa sallammenceritakan, ada wanita yang diadzab gara-gara menyiksa kucing. Karena kucing bukan termasuk hewan yang mengganggu atau membahayakan manusia.
Dari Ibnu Umar radhiallahu ‘anhuma, Nabi shallallahu ‘alaihi wa sallam bersabda,
عُذِّبَتِ امْرَأَةٌ فِى هِرَّةٍ سَجَنَتْهَا حَتَّى مَاتَتْ ، فَدَخَلَتْ فِيهَا النَّارَ ، لاَ هِىَ أَطْعَمَتْهَا وَلاَ سَقَتْهَا إِذْ حَبَسَتْهَا ، وَلاَ هِىَ تَرَكَتْهَا تَأْكُلُ مِنْ خَشَاشِ الأَرْضِ
“Ada seorang wanita yang diadzab karena seekor kucing. Dia kurung seekor kucing sampai mati, sehingga dia masuk neraka. Dia tidak memberinya makan, tidak pula minum, dan tidak dilepaskan sehingga bisa makan binatang melata tanah.” (HR. Bukhari 2365 dan Muslim 5989).
Ketentuan ini tidak hanya berlaku untuk kucing. Termasuk juga
مَا مِنْ إِنْسَانٍ قَتَلَ عُصْفُورًا فَمَا فَوْقَهَا بِغَيْرِ حَقِّهَا، إِلَّا سَأَلَهُ اللَّهُ عَزَّ وَجَلَّ عَنْهَا
“Jika ada orang membunuh seekor burung atau yang lebih kecil dari itu, tanpa alasan yang benar, maka Allah akan meminta pertanggung jawaban hal itu kepadanya.”
Para sahabat bertanya: “Ya Rasulullah, Apa haknya?”
يَذْبَحُهَا فَيَأْكُلُهَا، وَلَا يَقْطَعُ رَأْسَهَا يَرْمِي بِهَا
“Dia sembelih untuk dimakan, tidak mematahkan lehernya kemudian dibuang.” (HR. Nasai 4349).
Hukum Nabrak Kucing
Jika nabrak kucing ini di luar kesengajaan manusia, maka dia tidak menanggung resiko apapun. Kecuali jika hewan itu milik orang lain. Maka dia menanggung gati rugi ke pemiliknya.
Allah berfirman,
وَلَيْسَ عَلَيْكُمْ جُنَاحٌ فِيمَا أَخْطَأْتُم بِهِ وَلَكِن مَّا تَعَمَّدَتْ قُلُوبُكُمْ وَكَانَ اللَّهُ غَفُورًا رَّحِيمًا
“Tidak ada dosa bagi-mu untuk perbuatan yang kamu tidak senngaja, tetapi (yang ada dosa) apa yang disengaja oleh hatimu.” (QS. al-Ahzab: 5).
Sehingga tugas bagi mereka yang secara tidak sengaja menabrak kucing hingga mati adalah menguburnya, agar bangkai kucing ini tidak mengganggu orang lain.
Dr. Soleh al-Fauzan pernah ditanya tentang hukum menabrak kucing.
Jawaban beliau,
أما إذا لم تتمكن من ذلك ودهستها من غير قصد ولم تتمكن من الامتناع عنها فلا حرج عليك من ذلك، وإنما تأثم لو تعمدت قتلها بدون مسوّغ؛ لأنها حيوانات لها حرمة وليست مؤذية
Namun jika hal tersebut tidak memungkinkan lalu anda menelindasnya tanpa kesengajaan ingin menghabisi nyawanya karena anda tidak bisa menghentikan kendaraan secara mendadak maka anda tidak berdosa.
Anda berdosa karena membunuh hewan manakala anda dengan sengaja membunuhnya tanpa adanya alasan pembenar yang bisa dibenarkan karena hewan itu memiliki kehormatan dan dia tidak menyakiti anda. [ al-forqan. net/ fatawa/ 87. html ]
Apakah Ini Berpengaruh Pada Janin?
Kami tidak menjumpai adanya satupun dalil yang mengkaitkan antara tindakan membunuh binatang dengan kehamilan istri. Padahal kita sangat yakin, banyak istri sahabat yang hamil bertepatan dengan Idul Adha. Andaikan menyembelih binatang bisa berpengaruh buruk pada janin, tentu Nabi shallallahu ‘alaihi wa sallam akan mengingatkannya.
Sementara, meyakini sesuatu sebagai sebab terhadap sesuatu yang lain, padahal tidak memiliki hubungan sebab akibat, baik secara ilmiah maupun syariah, maka termasuk perbuatan syirik kecil.
